These Terms and Conditions set out the basis on which Rubbish Removal Notting Hill provides rubbish removal, waste collection and related services to residential and commercial customers. By making a booking or allowing our team to commence any work at your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 "Company", "we", "us" and "our" refer to the rubbish removal and waste collection service trading as Rubbish Removal Notting Hill.

1.2 "Customer", "you" and "your" refer to the individual or organisation requesting or receiving the services.

1.3 "Services" means rubbish removal, waste collection, clearance, loading, transportation, recycling and disposal services and any related activities provided by us.

1.4 "Premises" means the property or location where the services are to be carried out.

1.5 "Waste" means the items, materials and rubbish that you ask us to remove and that we agree to collect.

2. Scope of Services

2.1 We provide waste collection and rubbish removal services for domestic and commercial customers, including but not limited to household rubbish, office waste, garden waste, bulky items and general non-hazardous waste.

2.2 We reserve the right to refuse removal of any items that we reasonably suspect to be hazardous, illegal, unsafe to handle, excessively heavy or likely to cause damage, injury or breach of law during removal or transport.

2.3 Our services do not normally include disconnection of gas, water or electrical appliances, demolition, structural alterations or specialist hazardous waste handling, unless expressly agreed in writing in advance.

2.4 Any estimated or stated load capacity or volume is an approximation only. The final chargeable volume or weight will be determined by the actual quantity of waste loaded onto our vehicle.

3. Booking Process

3.1 You may request services by telephone, email or other booking channels we make available from time to time. All bookings are subject to availability and acceptance by us.

3.2 When requesting a booking, you must provide accurate information about:

(a) the address and access details of the premises;

(b) the type, approximate volume and nature of the waste;

(c) any access restrictions such as parking limitations, loading restrictions, stairs or narrow entrances;

(d) any items that may be hazardous, fragile or difficult to remove.

3.3 Based on the information you provide, we may give you an indicative quote or price range. This quote is not binding until the waste and access have been assessed by our team on arrival.

3.4 On arrival at the premises, our team will inspect the waste and the access conditions. We will confirm the final price before commencing work. If you do not accept the final price, you may cancel the service at that time, subject to any applicable call-out or cancellation charges described in these Terms and Conditions.

3.5 By confirming a booking, you warrant that you have the authority to allow us access to the premises and to arrange for removal of the waste in accordance with these Terms and Conditions.

4. Access and Parking

4.1 You are responsible for ensuring that we have suitable and safe access to the premises at the agreed time, including appropriate parking or loading space for our vehicle.

4.2 Where parking restrictions apply, you must obtain any necessary permits or authorisations unless we have expressly agreed in advance to arrange them. Any parking charges, penalty charge notices or related costs incurred as a result of providing the services will be added to your invoice.

4.3 If we are unable to access the premises or safely carry out the service at the agreed time due to issues beyond our control, we may charge a call-out or missed visit fee to cover our time and costs.

5. Customer Obligations

5.1 You must ensure that the waste to be collected is clearly identified and separated from any items that are not to be removed.

5.2 You must inform us in advance of any items that may require special handling, including but not limited to sharp objects, heavy items, electrical equipment, confidential materials or potentially hazardous substances.

5.3 You agree not to include in the waste any materials that are prohibited by law, including controlled substances, clinical or medical waste, asbestos, certain chemicals, flammable or explosive materials, pressurised containers or any other hazardous waste unless expressly agreed in writing and lawfully arranged.

5.4 If prohibited or hazardous items are found within the waste, we may refuse to remove them, impose additional charges for handling or disposal, or terminate the service, and you may be liable for any resulting costs, fines or legal consequences.

6. Pricing and Quotations

6.1 Prices are generally based on the volume and type of waste, the labour involved, access conditions and any additional services requested.

6.2 Any quote provided prior to our team visiting the premises is an estimate only, based on the information you have supplied. We reserve the right to revise the price if the volume, nature of the waste or access conditions differ from those described.

6.3 All prices will be communicated to you before work begins. Once you accept the price and the service starts, you are liable for the agreed charges.

6.4 Unless otherwise stated, prices are quoted exclusive of any government taxes or levies that may apply from time to time. Any such costs will be added to the final invoice where applicable.

7. Payments

7.1 Payment is due on completion of the service, unless alternative payment terms have been agreed with you in writing in advance.

7.2 We may accept payment by cash, debit card, credit card, bank transfer or other methods that we specify from time to time. We reserve the right to refuse certain payment methods at our discretion.

7.3 For account customers or commercial clients with agreed credit terms, invoices must be paid in full within the timeframe specified on the invoice. If no timeframe is specified, payment must be made within 14 days of the invoice date.

7.4 If you fail to make payment by the due date, we may charge interest on the overdue amount at a reasonable commercial rate from the due date until the date of payment in full, and we may suspend further services until the outstanding balance is settled.

7.5 You agree to reimburse us for any reasonable costs incurred in recovering overdue payments, including legal and debt collection fees.

8. Cancellations and Amendments

8.1 You may cancel or amend a booking by providing us with reasonable notice prior to the scheduled arrival time.

8.2 If you cancel less than 24 hours before the agreed time, we reserve the right to charge a cancellation fee to cover our administrative and scheduling costs.

8.3 If our team arrives at the premises at the agreed time and is unable to carry out the work due to your cancellation, lack of access, absence or other circumstances beyond our control, we may apply a call-out fee or missed visit charge.

8.4 We reserve the right to cancel or reschedule a booking where necessary due to operational issues, staff availability, vehicle breakdown, adverse weather, safety concerns or other circumstances outside our reasonable control. In such cases, we will notify you as soon as reasonably practicable and offer an alternative appointment.

9. Waste Handling and Regulations

9.1 We operate in accordance with applicable UK waste management and environmental regulations. We will transport and dispose of waste only at authorised facilities using lawful methods.

9.2 Once waste has been loaded onto our vehicle and payment received, ownership of the waste transfers to us, and we become responsible for its legal disposal, subject to the warranties and declarations you have made about its nature and contents.

9.3 You warrant that the waste presented for collection is your property or that you have full authority to arrange its removal and disposal.

9.4 We may, at our discretion, separate items for reuse or recycling where feasible, in line with environmental good practice. You agree that we may choose the most appropriate lawful disposal route for the waste, including re-use, recycling, energy recovery or landfill.

9.5 We may be required to retain records of waste collections and to provide information to regulatory authorities. By using our services, you consent to such lawful record-keeping and disclosure.

10. Liability and Limitations

10.1 We will exercise reasonable care and skill in providing the services. However, you acknowledge that waste collection and rubbish removal may involve the movement of bulky or awkward items through confined spaces, which carries a risk of minor scuffs or marks.

10.2 We will not be liable for pre-existing damage to property, fixtures, fittings or items on the premises, or for damage that could not reasonably have been avoided while carrying out the requested services.

10.3 You must notify us in writing of any alleged loss or damage arising from our services as soon as reasonably practicable and in any event within 7 days of the service date, providing reasonable evidence and details.

10.4 Our total liability to you for any loss or damage arising out of or in connection with the services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable for the specific service giving rise to the claim, except where such limitation is not permitted by law.

10.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

10.6 We shall not be liable for any indirect, consequential or purely economic loss, including loss of profit, loss of business, loss of opportunity or loss of goodwill, arising out of or in connection with the services.

11. Customer Indemnity

11.1 You agree to indemnify and hold us harmless from and against all claims, losses, damages, costs and expenses arising from:

(a) any breach by you of these Terms and Conditions;

(b) any misrepresentation regarding the nature, ownership or composition of the waste;

(c) the inclusion of prohibited, hazardous or illegal materials in the waste;

(d) any failure by you to provide safe and lawful access to the premises.

12. Insurance

12.1 We maintain appropriate insurance cover for our operations in line with industry practice. Details of our insurance can be made available upon reasonable request.

12.2 You remain responsible for maintaining adequate insurance for your own property and premises. Our insurance does not cover your own failure to properly insure your property.

13. Complaints

13.1 If you are dissatisfied with any aspect of our services, you should contact us as soon as possible so that we can seek to resolve the matter.

13.2 You agree to give us a reasonable opportunity to investigate and, where appropriate, rectify any issues before taking further action.

14. Force Majeure

14.1 We shall not be in breach of these Terms and Conditions or otherwise liable to you for any delay in performance or non-performance of our obligations where such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, strikes, lockouts, accidents, vehicle breakdown, fire, flood, acts of government or power failures.

15. Data Protection and Privacy

15.1 We will handle any personal information we collect from you in connection with the services in accordance with applicable data protection laws.

15.2 We may use your contact details to manage your bookings, process payments, improve our operations and, where permitted, provide service-related information. You may request access to or correction of your personal information by contacting us.

16. Variation of Terms

16.1 We reserve the right to amend these Terms and Conditions from time to time. Any updated version will apply to new bookings made after the date on which the revised terms are published or otherwise communicated.

16.2 For ongoing or pre-booked services, we will notify you of any material changes where reasonably practicable.

17. Severability

17.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.

18. Entire Agreement

18.1 These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between you and us relating to the provision of the services and supersede any prior discussions, correspondence or understandings.

18.2 You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.

19. Governing Law and Jurisdiction

19.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services shall be governed by and construed in accordance with the laws of England and Wales.

19.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services, including any non-contractual disputes or claims.
